ADDENDUM 1
This Addendum forms part of the Tender documents package, Tender #2023-002.pdf and is to be read, interpreted and coordinated with all other parts accordingly.
Addendum 1 contains responses to the following inquiries:
1) Can companies from outside of Canada apply for this?
o Answer: Yes, with proof that they can conduct business in Canada
2) Will meetings need to be conducted in person?
o Answer: Some meetings can be conducted by virtual meeting, however in person meetings will be required at some point.
3) Can tasks related to the RFP be performed outside of Canada?
o Answer: Tasks required to complete the Waste Strategy would most simply be completed within Canada by a consultant and/or a company that has proof they can conduct business in Canada.
4) Can proposals be submitted via email?
o Answer: Yes submissions must be submitted by email to [email protected].
5) Would the Township be agreeable to modifying the indemnity clause of 1.14.2?
“Consultant” (and competitors) are unable to obtain insurance for:
• Breach of contract (in the first paragraph), and
• Responsibility for perpetual indemnification (basically the second and third paragraphs).
o Answer: The proponent who submits a proposal and is the chosen candidate, is not obliged to include the version of the indemnification clause in the final contract. The specific terms of the final contract entered into with the consultant, are open to negotiation. Consultants may draft their own indemnity clause,
